businesssold.com.au is not involved as a broker, agent or lawyer for any buyer or seller, and we are not involved in negotiations, mediations or the actual transaction between the parties. An advertisement on this site is not an offer to buy or sell such advertised business.

Not Liable

This site is provided by businesssold.com.au on an "as is" basis. The Company and www.businesssold.com.au make no express or implied representations or warranties regarding the performance of this site or the information, content or businesses posted on this site.

The Company, including the directors, officers, employees and shareholders, and businesssold.com.au will not be liable for any damages of any kind arising from the use or content of this site, including any damages related to the truth, accuracy or completeness of any information posted about a business advertised on this site and the truth, accuracy or completeness of any other site or pages linked to this website.

No oral advice or written information given by the Company, including directors, officers, employees and shareholders, and businesssold.com.au will create a representation or warranty; and you cannot rely on any such information or advice.

Indemnity

You indemnify, defend and hold harmless the Company and businesssold.com.au and shareholders, officers, directors, employees, consultants, lawyers and agents of businesssold.com.au, from all third party claims, liability, damages or costs they incur as a result of your use or misuse of this website, your breach of these Terms of Use, or any relevant government or administrative body, law, bylaw, regulation or rule.

User Responsibility

You are solely responsible for the content of your information and advertisement.

Termination of Service

businesssold.com.au may, in its absolute and sole discretion and without notice, refuse or terminate service, restrict, edit or remove advertisements and cancel memberships.

businesssold.com.au reserves the right to edit, remove or restrict any content you post on the site at any time and for any reason.

The contents of this site, including icons, logos, graphics, the list of businesses for sale and businesses wanted on this site, and any other content on this site (the "Content"), is the property of businesssold.com.au.

Memberships

Individual Business Brokers can obtain Memberships to businesssold.com.au. Memberships cannot be assigned, licensed, or transferred to anyone or used by anyone other than the specific Member.

Memberships are subject to these Terms of Use and Privacy Policy and Membership privileges may be updated or revised solely by businesssold.com.au.

Memberships will be renewed at businesssold.com.au's current rate and charged to your credit card unless businesssold.com.au receives written notice prior to the renewal date.

Members may remove their businesssold.com.au Membership by cancelling billing via the PayPal payment interface.

Payment

You agree to pay businesssold.com.au by way of credit card and authorize businesssold.com.au to charge said fees to your credit card via its third party payment processor, PayPal. All fees paid are non-refundable after 24 hours.

If you fail to make a payment when due then businesssold.com.au may immediately terminate its services to you.

All legal fees and disbursements for the collection of late payments or arrears will be charge to you. businesssold.com.au may change its fees or billing practices at any time, and will provide notice of such changes to your last known address or email account.

You can remove your businesssold.com.au advertisement or membership by stopping your payment(s) via the PayPal payment interface.

Communication

businesssold.com.au uses email to communicate with you.

As a Customer, You authorize businesssold.com.au to communicate with you through your email, phone and fax.

businesssold.com.au is not liable for sending any email, fax or phone call to you or for the content of its message.

Entire Agreement - This Agreement sets forth the entire understanding and agreement between you and businesssold.com.au. All prior agreements, understandings, discussions, representations and warranties are superseded by this Agreement. No modification, waiver, addition or change to this Agreement will be valid unless given in writing by an authorized representative of businesssold.com.au.
